Welcome to Pickpad! By using our hardware, software, and services ("Services"), you agree to these Terms of Use. Please read them carefully.
1. Agreement to Terms
By using Pickpad Services, including logging into your account, installing our app or hardware, or accessing any part of our system, you agree to these Terms of Use and our Privacy Policy. If you do not agree, you must not use our Services.
2. Scope of Services
Pickpad provides smart order pickup systems powered by sensors and machine learning, designed to integrate with third-party systems. Our Services are used by:
- Clients (e.g., restaurants, retail stores and service outlets) who directly interact with Pickpad products.
- End-Customers (e.g., individuals placing orders) who indirectly interact with Pickpad through our Clients.
3. Public Agreement
By installing and using Pickpad’s Services, you grant Pickpad access to necessary data from your systems, such as POS, as outlined in the Privacy Policy. Continued use of our Services constitutes acceptance of this agreement.
4. Responsibilities of Clients
Clients using Pickpad Services agree to:
- Provide accurate information during onboarding and integration.
- Maintain secure credentials for third-party integrations, such as POS.
- Use Pickpad Services in compliance with all applicable laws and regulations.
- Ensure the privacy and security of End-Customer data as required by applicable laws.
Clients are solely responsible for their relationship with End-Customers, including order accuracy, data privacy, and compliance with relevant regulations.
5. Responsibilities of End-Customers
End-Customers interact with Pickpad Services indirectly through Clients (e.g., order pickup stations). By interacting with Pickpad-enabled systems, you acknowledge that:
- Any personal information (e.g., name, order details) is managed by the Client, not Pickpad.
- Pickpad is not responsible for order-related issues, such as delays or errors.
- Questions or concerns about your data should be directed to the Client (e.g., the restaurant or store).
6. Data Access and Limitations
Pickpad Services require limited access to data, such as order details and transaction information, to function effectively. Pickpad does not collect or store sensitive personal information like email addresses, phone numbers, or payment details unless explicitly authorized.
7. Intellectual Property
All content, technology, and designs associated with Pickpad Services are owned by Pickpad Inc. You may not copy, modify, or distribute any part of our Services without prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, Pickpad Inc. is not liable for:
- Errors or issues arising from third-party integrations, such as POS.
- Data inaccuracies provided by Clients.
- Disputes between Clients and End-Customers.
- Indirect, incidental, or consequential damages resulting from the use of our Services.
9. Modifications to Terms
Pickpad may update these Terms periodically. Continued use of our Services after updates signifies acceptance of the revised terms.
10. Governing Law
These Terms are governed by the laws of the State of Delaware.
